Notice of Rights, last updated in January 2012, describes the rights and entitlements for services and is to be placed into each class member’s permanent record, as maintained by all providers of residential and habilitative services. Therefore, it should be placed in the clinical file for the residence and day programs and in the service coordination record. Even in instances when the same agency operates the residence and day program, the Notice of Rights is to be placed in both records. The 1/2012 Notice of Rights is printed in sturdy PURPLE paper stock and should be placed prominently in the record. The Notice of Rights must NEVER be removed from any class member record. Presence of the Notice of Rights will be reviewed by the Division of Quality Improvement (DQI) during audit visits.
